Indonesia and Australia are on the verge of sealing a prisoner repatriation treaty - but do 'high-profile' Australian prisoners like Schapelle Corby actually want to return to an Australian jail? Will there be implications for other Australians serving prison sentences overseas?

> As for the 3 of the ‘Bali 6’ challenging their death sentences in the Constitutional Court - they win only if the Constitutional Court declares their death penalty 'unconstitutional' to Indonesian law... The other 3 of the ‘Bali 6’ on death penalty took their appeal to the Supreme Court. No PTA for Australians on the death sentence as we know.

**Kay Danes has sent Attorney General Philip Ruddock
some questions.

1. It has been suggested that the Indonesian-Oz treaty will involve prisoners serving a minimum half term prior to making application for transfer under the PTA scheme. If this is true, then why was it not possible to negotiate similar terms to the PTA between Thailand and Australia which requires a prisoner to serve 1/3rd their sentence prior to making application; or as with the HK agreement?

2. Will Indonesia allow remissions and a form of parole [conditional release]? If so, what form will this be in?

3. With regard to parole, if an Australian is released in Indonesia but still subject to parole conditions, can they apply to transfer back to Australia to undertake those parole requirements? I seem to recall that they can under the International Prisoners Transfer Scheme.

4. Will Australians serving life sentences in Indonesia be included in the PTA? Will their life sentence in Australia mean 'life' or would it equate to 25 years under Australian law?

5. I would also be highly interested to know the AG's view on prisoners who do not receive a fair trial in a foreign state, and if there is any legal challenge they might pursue when all legal challenges have been exhausted in Indonesia?

6. How should Australian citizens oppose the death penalty for the Australians in Bali, so as not to offend the Indonesian government? Is it simply by writing letters to Indonesia and is this effective in any way?
